Asked if the pilot had any criminal history, Sumwalt said it was too early in the investigation to know.
A Missouri police officer, though, told The Associated Press that Nichols was arrested there in 2000 on a felony driving while intoxicated charge and pleaded guilty to misdemeanor DWI in 2002. Calls to Heart of Texas operations manager Sarah Nichols, 72, rang unanswered, and a woman in Missouri believed to be his sister did not return calls seeking comment.

A member of the National Transportation Safety Board has criticized what he called a “disparity” in the FAA requirements for hot air balloon operators compared to airplane or helicopter pilots.

The company said investigators had not shared any information with it yet, making the company unable to speak with the families of the passengers.

Investigators have recovered cameras, iPads and mobile phones belonging the people on board the balloon. He said several passengers seemed to be related. At the time, Nichols owned a hot air balloon touring firm in St Louis County, Missouri. Board member Robert Sumwalt said the pilot was licensed to fly the balloon.
Bartch said she and Nichols remained friends and she helped him set up business operations in Texas in 2014.
She then adds: “The whole thing is in flames now”.
