3200 inmates released too early in Washington

The governor immediately ordered the DOC to halt all releases of impacted offenders from prison until a hand calculation is done to ensure the offender is being released on the correct date. “Early estimates indicate that the median number of days offenders were released from prison is 49 days before their correct release date”, the release reads. The computer fix is scheduled to be in place by January 7, 2016.

Brown says while as many as 3,200 offenders were released early, another 3,100 who are still incarcerated had inaccurate release dates. In accordance with a precedent set by the state Supreme Court, most of those offenders who were released early will be given day-for-day credit for their time in community. Based on the current average of incorrect calculations, most inmates released before this summer who have not been arrested for a new offense will have enough credit to remain out of prison. Inslee said he has tapped two retired federal prosecutors to lead an investigation into what happened. Five people have already been returned to cells. For more than a decade, the DOC’s system has been over-crediting some inmates and releasing them before their sentences were up. The problem was first discovered in 2012 when a victim’s family brought the issue to the attention of Department of Corrections officials.

The result is that up to 3,200 inmates have been released early to date, although a majority of those were only released as early as 55 days. “We will see what we can find out about this and whether any of these individuals have committed crimes and what crimes they committed when they should have been in prison, ” Padden said.

The bug meant that in one case a prisoner was released almost two years early
