Oregon attorney general files lawsuit against GNC alleging illegal ingredients

Ellen Rosenblum, the states attorney general, said Thursday the companys nutritional and dietary supplements are laced with unapproved drugs.

Regrettably, despite our best efforts, we were unable to reach an agreement with the Oregon Attorney General. In April, the FDA sent letters to five USA companies instructing them to immediately cease the manufacture and sale of their products that tested positive for BMPEA. The problem is that although GNC did not manufacture the products with the illegal ingredients, it did allow adulterated products to be sold.

The Food and Drug Administration assisted in the investigation.

“It’s scary to know that certain products sold by GNC contain an ingredient that is not even labeled – yet alone approved in the United States”, Oregon Attorney General Rosenblum said in a statement. The company also says it promptly took action to remove all products containing picamilon and BMPEA from sales following FDA statements regarding such products’ regulatory status.

“OSIM has confirmed that none of these products are sold by the group”, a spokeswoman told The Business Times on Friday afternoon.

Nutritionists have long warned that so-called natural supplements are office laced with caffeine and other chemicals that are the true source of “energy” touted in advertising, but this is damning evidence of possibly more worrisome ingredients.

The complaint states that the company is accountable, although it is only a retailer, because “GNC works closely with third-part vendors to ensure that labeling and marketing materials comply with GNC’s requirements and expectation”.
