Colorado theater shooter assaulted in prison

Holmes was not injured in the assault, DOC spokeswoman Adrienne Jacobson said, according to KDVR-TV in Denver. Inmate Mark Daniels, 27, lunged at Holmes and took a few shots at him when the two were being moved in the facility.

The Aurora theater shooter, now serving a life sentence with no possibility of parole in the highest state security prison, was allegedly attacked by a fellow inmate this month, and the assailant is facing charges. “The incident occurred during an offender movement”, Jacobson told the Denver Post.

Holmes is allowed to spend four hours in a day hall. The contact came as they were passing in a hallway.

Daniels is in jail for a variety of offenses including assault, menacing, smuggling contraband into prison and assaulting a prison guard.

In August, a judge sentenced Holmes to one life term for each of the 12 people he killed in addition to 3,318 years for attempted murders.

The inmate also assaulted a security officer in the prison as both inmates were escorted down a hallway.

Prosecutors sought the death penalty for the California native, who had pleaded not guilty by reason of insanity, but jurors could not unanimously agree that he should be executed.
