The court said the agency will also probe recent deaths of those associated with the case.

“Instead of deciding on a CBI probe, the Madhya Pradesh High Court washed its hands off (the case) and put the ball in our court”, the Supreme Court said. The governor’s constitutional immunity prevented him from being investigated in the matter whereas many others who were named along with him are now booked in a jail.

“So this is the new law of the land”. FIRs were registered against them. The court also issued a notice to the Governor.

“No, we are not saying anything now”, the CJI said.

“Now the Chief Minister is left with no moral authority to continue In his post”, he said.

The apex court will hear the matter on July 9.

In March, the Governor’s son, Shailesh Yadav, who had not been questioned by investigators, was found dead in Lucknow.

The scam dates to 2007, but investigations began only in 2013 after details emerged that many unqualified and undeserving candidates had been admitted into medical and engineering colleges.

Over the past four years, the CBI has registered a total of 45 cases against central government ministers, members of parliament and ex-ministers of state and central governments.

On April 16, 2014, a set of 14 writ petitions were filed before the High Court of MP at Jabalpur seeking transfer of the investigation STF to CBI.

The parade of deaths that apparently defies explanations has led to a countrywide outcry bolstering the opposition demand for a CBI probe into the who affair, which it describes as a sinister game.

A special investigation team (SIT) has been probing the irregularities in the various tests conducted by the MPPEB since 2013.

The Supreme Court has appreciated our prayer and accepted it, he noted.

He alleged that it was felt that if Governor came under probe in the scam, then the Chief Minister and his office would also come under the inquiry.
