US Attorney Minkler responds to Fogle sentencing

Under federal rules, Fogle must serve 85% of his sentence, which means more than 13 years in prison.

Fogle recounted how he tried to live an honorable life before he was caught up in “deception, lies and complete self-centeredness”.

According to court documents obtained by TheWrap, Fogle received multiple images of minors engaged in sex acts from Taylor and knew that those depicted were under 18.

“I want to become a good, decent person”, Fogle said, choking up during his statement.

Prosecutors are seeking a 12½-year prison sentence, while Fogle’s attorneys have asked for five years behind bars. Although the prosecution has recommended 12 years she could mandate an even long sentence, as the child porn charges carry a possible 20-year punishment and the sex with a minor charge carries a possible 30-year punishment.

After serving his sentence, Fogle will be a registered sex offender.

“Is everything I just stated… the truth?”

“Yes it is the truth, your honor”, Fogle said.

But four-plus hours of testimony from both sides Thursday yielded insights into the fall-from-grace of the man who used to be Milford-based Subway’s frontman.

Before the sentence, a forensic psychiatrist, Dr. John Bradford, argued that Fogle’s struggle with compulsive eating and drastic weight loss on the Subway diet made him hypersexual. He said there was a low to moderate risk of relapse.

In two’s deal, Fogle admitted that had sex at NY City hotels with two girls under age 18 – one of whom was 16 at the time – and paid them for that sex. Judge Tanya Walton Pratt said that this sentence “does not sufficiently account for the defendant’s criminal conduct”. “I want to rebuild my life”.

Fogle had been the face of the sandwich chain since he was featured in a commercial in 2000. The story of how he lost 245 pounds by eating Subway twice a day was a key part of its marketing campaigns.

Fogle’s attorney had announced in August that his client would enter a guilty plea to the charges, which came after a raid at the ex-sandwich pitchman’s in home.

Fogle cried during his statement and claimed his wife and two children would never get over his imprisonment – although in fact his wife has reportedly filed for divorce. In addition to prison time, Fogle paid out $1.4 million in damages to his victims.
