The Pirate Bay escapes block in Sweden

The court deliberated for a month to finally rule that the ISP is not to be held accountable for the actions of its subscribers.

The ruling comes after Universal Music, Sony Music, Warner Music, Nordisk Film and the Swedish Film Industry ganged up and dragged Bredbandsbolaget to court demanding it to block the site.

“When a judgment becomes precedent a trial is about so much more than an internet service provider and two controversial websites”, the executives said. Anders Dereborg, the Chief Magistrate in charge of the current case has stated that the Court does not have the right to do so because the culprit in this case is the Internet user and not the Internet Service Provider. The various groups had asked local ISP Bredbandsbolaget to block the service, but now it looks like the ISP will not have to.

Now, Stockholm District Court has passed the judgment in favour of the ISP and in a way supported The Pirate Bay. The site was able to setup five new domains in retaliation which redirected its users based on their region.

The filing party attempted to ban the website from Swedish ISP Bredbandsbolaget, suggesting the intermediary Pirate Bay to be responsible for its users and their uploaded material.

Of course the record company’s and film companies will probably appeal this decision and the case is expected to go to a higher court in Sweden in the future. But seeing as how this turned out, maybe they should reconsider their options first, especially if they lose again and will have to once again pay for the legal costs for the ISPs.
