Supreme Court had earlier on Tuesday issued a notice to the Centre on a fresh appeal from Nestle India Ltd challenging the order passed by the National Consumer Disputes Redressal Commission which had directed more tests on its Maggi noodles.

“…the consent was arrived that Mysore is well equipped with all tests and being a referral notified laboratory, sample should be sent there”, it said. The apex consumer body had directed that 16 samples of Maggi ought to be tested afresh. Now the Supreme Court again ruled Nestle to go for fresh testing. The test report, including earlier ones, will be produced before the court, the SC said, while restraining consumer panel NCDRC from going ahead with proceedings in the matter. “In the meantime, NCDRC shall not proceed”, the bench added up.

This was vehemently opposed by Attorney General Mukul Rohatgi, who said that on their request the sample has been sent to Chennai.

The NCDRC had ordered the testing of the Maggi noodles in the course of the hearing of the central government’s class action suit against Nestle India, the manufacturer of the noodles, seeking about Rs. 640 crore in damages for alleged unfair trade practices, false labelling and misleading advertisements.
