Nirbhaya gang rape: Juvenile convict will walk free on Sunday

The Delhi High Court on Friday refused to stay the release of December 16 gang rape case juvenile convict and said that the juvenile convict could be released on or before December 20.

The next date of hearing is on 28th March. The court has also issued notices to the Central and Delhi governments on the issue.

For three years, Jyoti’s parents Asha Devi and Badrinath had fought to stop the release of the juvenile.

In response to the petition, the Centre had sought extension of the juvenile’s stay in the observation home at Majnu Ka Tila in Delhi, till all aspects including his mental health and post-release rehabilitation plan were considered by the authorities.

The mother of the victim said she was “disappointed” with the ruling and that she would consider challenging the order in the Supreme Court.

The Delhi HC will take a decision whether the then juvenile, convicted in the gangrape and murder case will be released on December 20 or not.

He was sentenced to three years in a reform home, a punishment which was seen by many as disproportionate to the enormity of his crime and which spurred demands for changes to the law so teenagers involved in serious crimes can be tried as adults.

“If somebody like him will get launched, it clearly exhibits the helplessness of the federal government and the regulation of our nation”.

PTI reported that the high court said it can not prohibit juvenile’s release as per the statutory and existing provision of law.

“Even after all our efforts, the juvenile convict will now be released”. We did not get justice.

The juvenile convict has been alleged to be the most brutal of the other perpetrators.

The victim, who was brutally assaulted by six persons, including the juvenile, in a moving bus in south Delhi, had succumbed to her injuries in a Singapore hospital plunging the country into grief.
