“He [Rahm Emanuel] has essentially told everyone in the public, everyone in the City Council that my client actually murdered Mr. McDonald, and [that] he’s a bad apple and that he doesn’t belong in the police department and he committed acts that were indefensible”, Herbert said.

Herbert said he wants a county “outside the reach” of the mayor’s comments. He has been indicted by a grand jury on six counts of first-degree murder and one charge of misconduct.

Emanuel also denounced Van Dyke in comments to reporters on November 24, the day that Van Dyke was charged and the city satisfied a court order to release the police video to the public.

The indictment accuses Van Dyke of shooting McDonald without lawful justification, knowing his actions created a strong possibility of death. His defense has previously said Van Dyke feared for his life as McDonald reportedly had a knife. “And, you know, I understand the mayor has a job to do, but quite frankly I was upset that the comments continued to go on and on and on”.

Video of the shooting has triggered protests, forced the resignation of the city’s police chief and put the entire Police Department under a wide-ranging civil rights investigation by the U.S. Department of Justice. Van Dyke attorney Dan Herbert told the AP his client is expected to attend.

“We would like some federal oversight, so we could at least get a fair trial for our family member”, Hunter said.
