“I am hopeful because the kind of matter we have, the Supreme Court will take cognizance and will rule in our favour”, said Maliwal. He is to remain there for several weeks, as under the Act, there has to be a post-care plan for a juvenile who has been released.

The SLP has also stated that though the High Court was of the view that there was a need for mental assessment of the convict, there was no direction that before his release the authorities should go for a health and mental assessment of the offender.

The youngest of the six men convicted for the gangrape and murder of paramedical student Jyoti Singh, dubbed Nirbhaya, is set to be released from a correctional home this afternoon.

Maliwal further said that each and every person is against the release of the convict, however, everyone is feeling tied down by the Juvenile Justice Act. “But after December 20, a juvenile can not be kept in the special home per law”, the court had said rejecting a petition by BJP leader Subramanian Swamy.

– A vacation bench comprising Justices A K Goel and U U Lalit in their order pronounced at 2 AM, posted the matter for hearing on Monday.

The convict is likely to walk free from the undisclosed location today, in adherence to the existing legal provision, the sources added.

“The High Court judgment is correct that the law says three years and no way that any High Court or Supreme Court can change that”.

According to ANI, the victim’s parents had planned to stage a protest at India Gate earlier on Sunday, but were not allowed to as the police had imposed Section 144 in the area, which prohibits the assembly of more than 10 people. “Case subjudice now. Nirbhaya rapist should not be released until case heard”, she said in another tweet. Delhi government has said it had submitted a rehabilitation plan for the juvenile convict.
