The Bombay High Court has acquitted Bollywood Superstar Salman Khan off charges over a 2002 hit and run case. Seven months earlier, a sessions court convicted and sentenced him to five-year imprisonment.
This picture from 21 October 2002, shows policemen escorting Bollywood star Salman Khan (C) to a court in Bombay. The judge also said the prosecution had been unable to prove that Khan was drunk that night, as merely producing restaurant bills was not enough proof of his inebriated condition.
The judge said the prosecution should have examined Kamaal Khan, singer friend of Salman, who was with him in the Toyota Land Cruiser when the mishap occurred on September 28, 2002.
The High Court said he can’t be found guilty based on the evidence presented.
“The trial court’s verdict is quashed and set aside”, Justice A.R. Joshi said in reading the verdict to a crowded courtroom, according to the Press Trust of India news agency.
The judgement reversed the sentence given by a Mumbai sessions court in May, which had charged the 49-year-old actor with culpable homicide. Khan was then granted bail.
After pronouncing the verdict, Justice Joshi left the court following which Salman came out of the witness box and mingled with his family and lawyers.
Another witness from the bakery, Ramasrey Pandey, who was injured in the accident also turned hostile and told the court that he had not seen the actor behind the wheel of the SUV.
“Even if Patil’s statement has to be considered as partially reliable, there has to be corroboration in evidence which does not exist in this case”, Joshi said. The Magistrate’s court had conducted the trial for a much lesser offence of causing death by rash and negligent driving.
