Gangrape victim’s mom wants to see bill passed
Nirbhaya’s parents Asha Devi and Badrinath Singh had earlier in the day met Minister of State for Parliamentary Affairs Mukhtar Abbas Naqvi and urged early passage of the bill in parliament. “As of now I’m happy that the Juvenile Justice Bill has been passed in Parliament today”, he said.

Ramdas Athawale, a BJP ally from Maharashtra, made remarks that provoked objections from many lawmakers during the debate before the bill was passed in the upper house. Some news channels went as far as initiating campaigns and starting petitions in their war-cry to get the bill passed to deliver “justice” to Nirbhaya, ignoring the fact that criminal laws can’t be applied retrospectively.
The wait within the passing of the statement, that was handed by Lok Sabha in-May, had come under sharp emphasis recently with Nirbhayais parents plus some different companies protesting from the launch of the juvenile active in Dec 2012 gang rape, and homicide that had shaken the mind of the whole country. Juveniles committing heinous crimes must be tried in a criminal court as adults. When the government side sought to remind them that had agreed to pass six bills including the Anti-Hijacking Bill, the Atomic Energy (amendment) Bill, the Commercial Courts ordinance Bill and the Arbitration and Conciliation (amendment) Bill, before the session ends, there was no response from the Congress. Seeking more deliberations on lowering the age to 16 years, he questioned what would happen if a 15-year-old commits a crime.
Referring to media reports that the convict in the December 2012 gangrape-cum-murder was radicalised in remand home, Gandhi asked what exactly were Kashmiri terrorists doing in a children ” s home in the same place as a juvenile convicted of rape. Child-rights activists have slammed the bill, claiming that it is regressive and will make children vulnerable.
Women and Child Welfare Minister Maneka Gandhi said there can not be a more nuanced Bill on the matter.
Women and Child Development minister Maneka Gandhi reiterated that no juvenile will be sent directly to jail if the act comes into force. “And if they have sex, then it should be consensual”, the 55-year-old parliamentarian said. “We have listed it for tomorrow”, he said, adding if all agree the bill can be taken up for discussion today itself. Out of the total crimes recorded by National Crime Records bureau, less than 3 per cent crimes are committed by juveniles, whereas, 97 per cent are committed by adults who are well-aware of the stringent punishment they would face on conviction. “It’s a tribute to her, it’s a good message”, said Jyoti’s father. “If it is perceived that it was a thought-out, adult and planned crime, it would not be considered a child-like crime”.
“I think that is the sense of the house”, Deputy Chairman P.J. Kurien said.
