National Herald Case: Sonia, Rahul Gandhi May Seek Bail
“Today, we realized that the grand old party, which was expert in carrying out corruption during their rule, has become experts in carrying out corruption as an opposition as well”. The trial courtroom then issued summons to the 2 leaders amongst others in June 2014, however they approached the Delhi High Court in search of a keep. “This is a victory for democracy”, Swamy told media outside the court premises. Manmohan Singh, Sonia Gandhi’s daughter Priyanka Vadra, former Delhi chief minister Sheila Dikshit, Ghulam Nabi Azad, Mallikarjun Kharge, Rajiv Shukla, Ajay Maken, Kumari Selja and A.K. Antony were already present in the court room to express solidarity when the Congress chief entered the court. Mr Singh also clarified that the bail did not exempt them from subsequent court appearances.

However, many confessed that the National Herald case was an unnecessary distraction as their energies will now be expended on defending Sonia and Rahul Gandhi and explaining the facts of the case instead of exposing the failures of the ruling alliance at the Centre as well as BJP-led state governments.
Rahul Gandhi, who also appeared before the judge, backed the party president’s assertion. “I am here since morning just waiting for the lifetime opportunity to see Sonia and Rahul Gandhi”, said a lawyer standing in the huge crowd. Yes, if they had refused to furnish bail bonds they would have had to go to jail.
His plea, however, was not accepted by the court.
Outside, the party engaged in a political battle, attacking Prime Minister Narendra Modi for “targeting his opponents” and terming Bharatiya Janata Party (BJP) leader Subramanian Swamy his “stooge”.
Sibal, while arguing further, said that the petitioner had not completed the formality under Section 204 of Code of Criminal Procedure (CrPC) which mandates the annexing of documents in public domain and public witnesses along with the summons.
At one point, Sonia Gandhi, clad in a maroon saree, even fell a step behind Rahul while trying to oblige a call from photographers.
He alleged that AJL had received an interest-free loan of Rs 90.25 crore from the Congress and that the party transferred the debt to Young Indian private Limited for Rs 50 lakh. “They were not allowed to sit except Vora”, he said.
According to top sources, the party would first consult with lawyers before taking the step. Swamy said that he was ready for the matter to be taken up in January 2016 but they pleaded and said, “Please extend it till February 20”, to which he agreed.
The Congress leaders are likely to move the Supreme Court not to seek a stay on proceedings in the lower court but to have the remarks of the Delhi High Court in the court order like “smacks of criminality” and “criminal intent” expunged.
Sonia Gandhi later said she appeared before the court with a clean heart as a law-abiding citizen should do.
Sonia said the government is misusing its agencies, “but none of us will be frightened as our struggle will continue”. We are not afraid. “Our fight will continue”.

He also raised questions about statements made by senior BJP ministers on the issue to support his contention that the government was indulging in “political vendetta” and also referred to the removal of the previous Enforcement Directorate Chief. “Modiji levels false allegations against and thinks that the Opposition would bow down before him”, he said. The Congress and I will not bend.
