A Minnesota judge has refused to block a Mall of America demonstration on Wednesday by Black Lives Matter, despite finding that the mall is private property that can bar activity hostile to its business.

Yesterday, there was a 2 p.m. hearing at the mall’s request at Hennepin County District Court in Minnesota, and a ruling is expected today. The disruption caused several stores to temporarily close and dozens of arrests were made.

The mall’s attempt this week to get a judge to shut down the protest failed. The mall is private property and doesn’t allow demonstrations.

At a Black Lives Matter protest at the mall last December, protesters were met with an aggressive response by police and then heavily prosecuted by the Bloomington attorney.

Human rights advocates and witnesses say Clark was handcuffed when an officer shot him in the head.

The privately owned mall says another demonstration would mean lost sales, mirroring a major protest past year.

Last year’s protest by BLM caused an estimated 24,000 people to bypass shopping at the mall, according to traffic statistics in court documents filed by the mall. As NPR reported at the time, protesters and police differ on the circumstances of Clark’s death. Black Lives Matter called for the demo in order to draw attention to the recent fatal shooting of a young black man by Minneapolis police.
