A judge ruled Tuesday that several local Black Lives Matter organizers cannot demonstrate at the Mall of America on the busy shopping day before Christmas Eve, but she said she couldn’t stop others from attending the protest.

The court denied the mall’s request to order the defendants to remove calls for protest posted on social media and to post a new message saying that the event has been canceled.

Black Lives Matter said the mall was trying to bar free speech “on its premises despite receiving hundreds of millions of dollars of taxpayer subsidies which it has used to appropriate the traditional public forum in service of its own corporate profit”.

The mall sought a court order blocking the planned protest.

Black Lives Matter protesters caused a temporary shutdown at the Mall of America on the Saturday before Christmas in 2014, according to local CBS affiliate WCCO-TV.

There’s not much Mall of America can do to avoid this mess.

The privately owned mall said another demonstration would mean lost sales. Hopefully, there will be enough police present to deter vandalism and destruction of property, but don’t bet on it. BLM needs a media home run and an incident at the largest mall in America would fill the bill. They also protested at the Minnesota State Fair and shut down sections of the Twin Cities’ light rail system during the Minnesota Viking’s first home game.

Police in Bloomington, Minnesota where the Mall of America is located, were also keeping their plans a secret, “generally as a precautionary measure”. But it did not grant a restraining order against the broader organization, Black Lives Matter Minneapolis. Mall officials tried to block the protest, arguing the mall was on private property, but a judge only barred three organizers from attending. However, she granted an injunction against just three individuals, ruling-I think correctly-that “Black Lives Matter” is not a legal entity against which an order can be entered. They want to press authorities to release video of the shooting that remains undisclosed.

Wednesday’s short protest marked the second consecutive year that the loosely organized movement, which grew out of protests over police killings in Ferguson, Missouri, New York and other cities, had demonstrated near the peak of the holiday season. Minnesota Governor Mark Dayton said on Wednesday that 30 state patrol officers would be present in uniform as a backup reserve at the request of Bloomington police. “That is a powerful message that hopefully this year will get through”, she said. Although police have said Clark was actively resisting arrest as police intervened in an assault that he was allegedly involved in, activists say he was not resisting and was lying on the ground handcuffed when he was shot.
