NY Attorney General Asks Court to Deny Stay on Fantasy Sports Ruling
Following similar rulings in Nevada and New York, Illinois Attorney General Lisa Madigan declared Wednesday daily fantasy sports sites such as DraftKings and FanDuel constitute sports gambling under state law, according to ChicagoBusiness.com’s Danny Ecker. “While I do not believe daily fantasy sports involve gambling, I have explained my concern from the outset of my work that IL law is unclear on this issue”. The state rep who proposed the bill issued a statement Wednesday that he would continue working within the legislature to eventually allow the games to be played.

The court should deny the stay, he says, since DraftKings and FanDuel “offer nothing more than a rebranded form of sports betting”.
“It clearly declares that all games of chance or skill, when played for money, are illegal gambling in IL, unless excepted”, Madigan wrote.
Traditional fantasy games are exempted because it’s played over a period of time, whereas daily fantasy games take place in a single day or just a week.
Madigan’s office also sent letters to DraftKings and FanDuel in which it made it clear that it expected both sites to cease operations in the state.

“To me, it didn’t make sense to consider legislation when we didn’t know what the current status of daily fantasy sports is in Illinois”, Drury said.
