In a press statement he called the actions of the police “a flawless storm of human error”, adding that evidence presented “did not constitute criminal action by police”.

Attorneys for the Rice family reiterated some of these criticisms in a statement released Monday, saying they were “saddened and disappointed by this outcome-but not surprised”.

Mr Loehmann said that he then saw Tamir’s elbow moving upward, and that the weapon was coming up out of his waistband so he fired two shots. The city also reached a settlement with the U.S. Department of Justice this year to institute numerous reforms, including an overhaul of the police department’s use-of-force policies.

Speakng to MSNBC by phone, family attorney Earl Ward said that Tamir’s mom, Samaria Rice, was “devastated” by the grand jury decision, having “wanted justice” for her son.

Rice’s killing follows other notable instances of black males being killed by white police officers int he USA, including the cases of Michael Brown and Eric Garner.

In a statement sent shortly after the prosecutor’s announcement, Kasich says OH has made progress in improving how police and communities work together.

“We all lose, however, if we give in to anger and frustration and let it divide us”, he said.

At 3:30 PM Monday, sheriff’s deputies were preparing for protests outside the Cuyahoga County Justice Center, where the officers likely would have been tried. Five people held up signs, with pictures of Tamir and other people who have been fatally shot by police around the country.

Officer Timothy Loehmann opened fire within two seconds of opening his squad auto door, killing Rice.

The way Prosecutor McGinty has mishandled the grand jury process has compounded the grief of this family.

In detailing the decision not to bring charges, McGinty said police radio personnel contributed to the tragedy by failing to pass along the “all-important fact” that the 911 caller said the gunman was probably a juvenile and the gun probably wasn’t real. It was missing its telltale orange tip. McGinty announced that the decision was in line with his recommendation, citing that the officers acted within reason.

“Viewing the video alone, however, provides an incomplete picture”, Assistant County Prosecutor Matthew Meyer said Monday. “It would be irresponsible or unreasonable if the officer was required to wait and see if the gun was real”.

The death of Tamir Rice spurred civil rights activists nationwide to demand justice in the face of what they said was police brutality, which continues to be exercised with greater frequency against African Americans.

In October, an “expert” Colorado prosecutor, S. Lamar Sims, delivered a report that Loehmann’s shooting was “justified” in the incident. Tamir was holding a pellet gun when he was killed.

McGinty said he also recommended that no charges be filed.

The officers approached the park from a side street, pulling directly up on the grass where Tamir was playing rather than approaching from the paved parking lot. It should never happen again, and steps have been taken to make sure it is not.

Officer Loehmann ended up shooting Rice just seconds after arriving onto the scene, according to video footagethat was released after the incident. Both sets testified before the grand jury.

Tamir’s death on November 22, 2014, was caught on choppy surveillance video that stoked public outrage and prompted fresh calls for police reform.
