At a Tuesday news conference, one day after the two were apprehended at a Mexican hideaway, Tarrant County Sheriff Dee Anderson addressed the way Ethan’s mother handled his upbringing. He would not give details about the event including how many people attended.

The “affluenza” nickname for the teen came from a psychologist who said during Couch’s trial he was so wealthy and spoiled he could not tell the difference between right and wrong. The condition is not recognised as a medical diagnosis by the American Psychiatric Association and its invocation drew ridicule.

Couch and his 48-year-old mother were tracked down in Mexico and taken into custody on Monday evening in the Pacific Ocean beach city of Puerto Vallarta. The teen’s father was said to be cooperating with investigators.

Ethan Couch and his mother were detained in Puerto Vallarta. But shortly after he completed it, a short video surfaced on Twitter that appeared to show him drinking at a party.

Anderson said an arrest warrant would be issued for Couch’s mother, Tonya Couch, on charges of hindering an apprehension. Tarrant County district attorney Sharen Wilson said she planned to ask a judge to transfer Ethan Couch’s case to adult court. He can be sentenced to 120 days in jail as a condition of adult probation, and then would continue the remaining eight years of his probation. In the adult system, he would face up to 40 years in prison if he violated probation again after that, Wilson said.

At a previously scheduled January 19 court hearing, Wilson had planned to ask a judge to transfer Couch’s case into the adult court system from the juvenile system, putting Couch under stricter supervision and leaving him open to harsher punishment if he violated probation.

Ethan Couch’s attorneys, Scott Brown and William Reagan Wynn, issued a written statement Tuesday.

They were both handed over to the National Migration Institute after they “could not prove their legal status in Mexico” and authorities will send them back to the United States, the prosecutor’s office said in a statement. “They would have had to enter, for example, as tourists, but they entered without registering”.

In June 2013 at age 16, Couch was driving drunk and speeding on a dark two-lane road south of Fort Worth when he crashed into a disabled SUV off to the side, killing four people and injuring several others, including passengers in Couch’s pickup truck.

Couch has been serving 10 years drug-and-alcohol-free probation for intoxication manslaughter – a sentence that sparked outrage among critics who said he had been lightly punished because of his privilege.

The hunt for Couch began a few weeks ago after he missed a mandatory meeting with his probation officer.
