After the Temple employee, Andrea Constand, accused Cosby of sexually assaulting her in 2004, a Montgomery County prosecutor decided in 2005 that charges weren’t warranted in the case.

Cosby’s attorney, Monique Pressley, has now declared her client will not be taking a plea deal, and she believes the 78-year-old will be cleared of the charge.

Following his arrest, Cosby was released on $1 million bail and ordered to turn over his passport. Cosby allegedly drugged Constand before penetrating her with his fingers.

“On behalf of our client we are happy to see that Mr. Cosby will hopefully be brought to justice and the criminal court system”, said her lawyer, Spencer Kuvin, in a statement. The charges were filed one day before the legal deadline. She vowed to fight the charges and said Cosby would not accept a plea agreement. He said she never told him to stop.

In many other alleged assaults from decades ago, Cosby can’t be charged because the statutes of limitations have passed. Cosby admitted to giving Quaaludes to a woman with whom he wanted to have sex, according to the paperwork. The first criminal charges against Cosby over his conduct with women were filed just a few days before Pennsylvania’s 12-year statute of limitations was set to run out, the Associated Press reported.

On Wednesday, Steele outlined a timeline of events in 2004, saying Cosby established a friendship with the victim and then made sexual advances that were rejected. “But we’re focused on getting to the facts on this very old case that was once decided such that the former D.A. said there was no need to go further and that it belonged in the civil courts”, she said.

George Kontos, who represents a Cosby accuser in Pittsburgh who is suing him in civil court, said he had heard charges against Cosby were “forthcoming” for some time.

At least 50 women have publicly accused Cosby of sexual assault. But since Constand trusted Cosby, she continued their relationship and felt comfortable going to his house alone.

Bill Cosby has long maintained that his extramarital conquests over the years were all consensual.

“Bill Cosby has spent his life attempting to silence the women he has assaulted with threats, lawsuits and money”, he wrote adding, “Hopefully now many of these women will get to tell their stories in a court of law and the people who supported him will get deposed”.

Armed with that information, prosecutors made a decision to reopen the criminal investigation and dozens of other women came forward with similar allegations.
