DDCA Scam: MHA declares Commission of Inquiry into irregularities “Unconstitutional and Illegal”

BJP’s charge came after a defiant Kejriwal said the Commission of Inquiry constituted by the Delhi government would continue its probe into alleged irregularities in DDCA even after it was declared illegal by the Home Ministry.

Kejriwal said the commission was appointed in accordance with law and the Constitution and asked the Lt Governor, Ministry of Home Affairs and the Prime Minister’s Office to approach the judiciary in case they were “aggrieved” with the panel.

Delhi government has appointed former Solicitor General Gopal Subramaniam to head the probe panel. That opinion “is not binding on the Delhi government”, Mr Kejriwal tweeted. Earlier, the Centre had declared as “unconstitutional and illegal” the setting up of of commission of inquiry into the DDCA affairs by the AAP dispensation.

Kolkata: After sparring over the DDCA issue, Union Finance Minister Arun Jaitley and Delhi Chief Minister ArvindKejriwal today shared stage at the Bengal Global Business summit here.

The view in the home ministry was that the Delhi government issued that notification without Lieutenant Governor’s approval.

Kejriwal accused Jaitley of facilitating the massive corruption during his tenure and the latter sued the Chief Minister on defamation ground. The ministry held the Delhi government was not a competent authority to set up this kind of inquiry under the provisions of the Constitution and the Commission of Inquiry Act of 1952.

He said, “In the CNG fitness scam also, we had set up an inquiry commission”.

“The home ministry has conveyed its decision to the L-G”. It does not apply to the Delhi government as Delhi is not a state, but a National Capital Territory, the notice said.

“It has been proved that the Modi government has no intention to probe any irregularities in DDCA and the Centre’s move is legally and politically wrong”.
