New York City’s first and only standalone Chick-fil-A restaurant has reopened Tuesday, after it voluntarily shut down its operation for almost a week due to health code violations that give it a “C” grade.

The fast-food restaurant, at 1000 Sixth Ave.at the corner of West 37th Street, was cited in a December 24 inspection for the presence of “filth flies”, such as fruit flies, and for not storing food at the proper temperatures, among other issues. They included: Cold food item held above 41°F (smoked fish and reduced oxygen packaged foods above 38°F) except during necessary preparation; food not cooled by an approved method whereby the internal product temperature is reduced from 140°F to 70°F or less within 2 hours and from 70°F or less within 4 additional hours. The restaurant was also found to not be vermin proof. About three months later, following a Christmas Eve health inspection that “uncovered a host of critical violations, resulting in 59 violation points”, the metro-Atlanta based chain closed to store for maintenance, Gothamist reports.

“Closing the restaurant voluntarily has allowed us the time to make facility and procedural changes that will better meet the needs of serving our guests while operating in a very busy urban environment”, the release says. According to the DOH homepage (PDF), if a restaurant receives a low grade, it can opt to post a “Grade Pending” sign “until it has an opportunity to be heard at the Office of Administrative Trials and Hearing Health Tribunal”. Records now show the grade for this Chick-fil-A restaurant is “grade pending”.
