The case is Schwartz v. Cruz, 4:16-cv-00106, U.S. District Court, Southern District of Texas (Houston). His mother was a USA citizen and his father is Cuban.

Cruz was conferred American citizenship at birth because his mother is an American citizen, and legal experts have largely agreed that would qualify him for natural-born citizenship.

Law professor Gabriel Chin of the University of California at Davis wrote a paper arguing that McCain’s birth outside USA borders, in the Canal Zone, made him ineligible for the presidency.

“We’re losing our country and we have to be courageous and stand up for God and what’s right”, said Ellen Kayton, after hearing Cruz at an event centered on religious liberty here in SC this fall. For years, he’s been a leader in what’s known as the “birther” movement, which is comprised of conspiracy theorists who believe that although Obama’s mother was an American citizen, the president was born in Kenya, which is his father’s homeland.
Cruz was dismissive of Trump’s statements, saying he had only brought his birthplace up because of Cruz’s gain in polling in Iowa.
In the new ad, Trump runs through his central campaign platforms, including his vows to strengthen the country’s borders, “fix” it’s health care system and the military, and take better care of veterans.

“Standing’s only going to work if some state denies Cruz access to the ballot”, Vladeck said, at which point Cruz himself could sue to have it resolved.
