California man charged with hitting Uber driver sues driver

The former Taco Bell executive who created an internet firestorm when he appeared on dash-cam video beating an Uber driver last October, has reportedly filed a lawsuit against the driver.

The Orange County Register reported Saturday (http://bit.ly/1QdIO5A ) that Golden filed a cross-complaint last month saying Caban illegally recorded him and posted the video to YouTube.

Golden was arrested after the incident, and is charged with multiple misdemeanor charges of assault and battery.

Taco Bell fired Golden from his job as a marketing manager over the incident.

Mr. Golden’s lawyer, Courtney Pilchman, told CNBC that she will seek to have the video of the attack barred from evidence in the criminal case against Mr. Golden, alleging that the video was illegally recorded.

Caban said he stopped working with Uber after the incident, citing concerns about safety. “I’m ashamed to say I got to that point”.

Golden was also swearing at Caban, he claims, telling him to ‘f****** turn this piece of s*** around’.

Caban claims that Golden then became aggressive, slapping him, grabbing his hair and slamming his head against a window.

“Mr Golden accepts full responsibility for his actions and understands the consequences that may occur as a result”, Ms Pilchman said in November.

The brief video shows what happens after Caban tells Golden to get out because he’s too drunk.

Golden is claiming that he was recorded without consent and is also suing those who distributed the video after the fact.

The lawsuit claims invasion of privacy, negligent infliction of emotional distress, intentional infliction of emotional distress, assault and battery.

Golden claims to have “suffered severe emotional distress, humiliation, anxiety, fear, pain and suffering” along with his loss of job, according to the new suit, which was obtained by CNBC.

Golden also denies causing any harm to Caban, and says that if any harm was caused, it was due to “the negligence, fault or carelessness” of Caban himself.

“It [the suit] just tells me how disingenuous Golden was on his apology tour”, Morrell told CNBC. The lawyer also said that he believes that the state penal code only applies to audio recording, not video recording.
