Lindsay Lohan’s GTA V Lawsuit Against Rockstar Will Be Going Forward

Actor Lindsay Lohan has won the first round of her image rights dispute with the makers of the “Grand Theft Auto” (GTA) video games after a United States court ruled that questions need answering before the lawsuit can be dismissed. The character Lacey Jonas is alleged to be based on Lohan. This not only detailed the use of her likeness in the game cover and promotional materials, but also pointed out Rockstar made references to aspects of her career and life, including her career rise following Mean Girls, and her residence in a West Hollywood hotel.

She later added to the suit that she was supposedly the inspiration behind one of the game’s posters (the one with a lady in a bikini taking a selfie – see below) even though model Shelby Welinder has confirmed that she was in fact the model that Rockstar used for the poster. Finally the movie “star” is back in the news with her pending Grand Theft Auto case.

Take-Two had hoped to have the case dismissed for being “legally meritless” and Lohan’s claims having only been “filed for publicity purposes”.

According to TheHollywoodReporter, on Friday New York Supreme Court judge Joan Kenney decided she wants to hear what Lohan’s legal team has to say.

“Defendants have not been able to prove, at this juncture of the litigation, that the republication exception to the one year statute of limitations is not applicable to this case”, she concluded.

The amusing part is that tons of GTA 5, Rockstar Games and Take Two Interactive fans have taken to Twitter making fun of her decision to file a case with the hashtag #LindsayIsNuts.
