North Carolina, Justice Department file lawsuits over state bathroom law

In response, Governor McCrory filed his own desperate lawsuit against the federal government yesterday.

McCrory said Sunday that this action sets a precedent, with the federal government “now telling every university that accepts federal funding that boys who may think they’re a girl can go into a girl’s locker room or restroom or shower facility, and that begins I assume tomorrow”.

Supporters of the law say policies that allow transgender people to use toilets according to their gender identity increases the threat of sexual assault.

“Denying such access to transgender individuals, whose gender identity is different from their gender assignment at birth, while affording it to similarly situated non-transgender employees violates” provisions of federal law, wrote Vanita Gupta, the department’s top civil rights lawyer.

North Carolina Attorney General Roy Cooper, a vocal opponent of the homophobic, transphobic House Bill 2 and the Democratic candidate for governor, has filmed a video taking the state’s governor to task for not only signing the bill but filing a federal lawsuit to keep it on the books. “2”, reads the lawsuit filed Monday.

Earnest says the Justice Department’s action was taken “independent of any sort of political interference or direction from the White House”. “The overwhelming weight of legal authority”, his suit said, “recognizes that transgender status is not a protected class under Title VII”.

Ryan Anderson of The Heritage Foundation said the backlash against the law is “cultural cronyism” where businesses and government collude to have their way.

“The Department of Justice has already been clear that it violates the civil rights of North Carolinians”, he said in a statement.

North Carolina Gov. Pat McCrory is going to court in a fight for a state law that limits protections for lesbian, gay, bisexual and transgender people.

The Obama administration has revealed plans to sue North Carolina over its controversial anti-LGBT law.

Lashing out at the Justice Department’s “bullying”, Family Research Council President Tony Perkins said that President Barack Obama was trying to “fundamentally transform America”.

Now the USA has threatened to stop funding the North Carolina Department of Public Safety and the University of North Carolina – the State stands to lose millions of dollars in funding.

The case is the latest move in a battle between some conservative state governments and civil rights activists following the US Supreme Court ruling that legalised same-sex marriage in 2015.
