FDA Announces New Regulations to Prevent Youth Access to Tobacco Products

United States authorities unveiled a broad set of rules on e-cigarettes and cigars, prohibiting their sale to minors and requiring makers of the products to get federal marketing authorization. “Each juice that we create, in house, basically is facing a one-million dollar application”.

Tobacco producers will need to receive FDA authorization to sell new products and to market them as “light”, “low” or “mild”.

California already barred people under the age of 18 from buying e-cigarettes, so the federal rule won’t change that.

The rule also will require manufacturers to show that newly manufactured products meet a public health standard, unless the product was on the market as of February 15, 2007.

“E-cigarette shouldn’t be sold to minors, and government should restrict advertising so they aren’t marketed to kids”, Stier said.

The rule would subject all tobacco manufacturers the Family Smoking Prevention and Tobacco Control Act of 2009, which requires cigarette producers to list manufacturing plants and products, disclose their ingredients and include health warnings on packaging and advertisements.

“It’s one of the things that keeps people off of cigarettes, is they take pride in the device that they have that looks really nice”, Sandvig said.

FDA Commissioner Robert Califf said use among students over the past five years has skyrocketed from 1 percent to 16 percent, “These numbers are concerning because we know nicotine is addictive”. They lack the chemicals and tars of burning tobacco, but they have not been extensively studied, and there’s no scientific consensus on the risks or advantages of “vaping”. “As cigarette smoking among those under 18 has fallen, the use of other nicotine products, and especially E-cigarettes has taken a drastic leap”.

But the FDA seems less concerned about adults trying to quit smoking and more anxious about teenagers who are getting into vaping.

The requirements apply to “new tobacco products” on the market before February 2007, but reports noted that almost all e-cigarettes debuted after that date.

These rules go into effect in 90 days, but manufacturers have two years to come into compliance.
