Tom Brady to Appeal ‘Deflatgate’ Suspension Again

Rehearing the appeal would delay the enforcement of Brady’s suspension, potentially allowing him to start for the Patriots in Week 1 of the 2016 season.

Last month, a three-judge panel ruled that Commissioner Roger Goodell was within his rights to suspend Brady for “Deflategate”.

According to ABC, Brady will appeal en banc, asking the entire panel of the 2nd U.S. Circuit Court of Appeals to participate in the hearing.

The court will then have to decide whether to rehear Brady’s case, which will be determined by a majority vote of its 13 judges.

If the Second Circuit agrees to hear the case en banc, it’s very likely Deflategate is going to extend into a third offseason, with Brady probably cleared to play via a new stay. He departed from what happened before.

Monday was the final day that Brady had to file appeal after the ban was upheld last month. “He departed from that completely and went off the track”.

Goodell authorized Troy Vincent, the NFL’s executive vice president of football operations, to discipline Brady and the Patriots, who were fined $1 million and forfeited two draft picks, including a first-rounder this year. Such cases are rarely heard, making it possible that the case ultimately will be sent to the U. S. Supreme Court.

Most have said that Brady’s chances to get the suspension overturned are not good, however, if it takes long enough, when he actually serves his four-game penalty could change from just the first weeks of the season. That could save Brady nearly $2 million in lost salary during a four-game suspension. AFC rivals are hopeful. “We’re set up with a tough schedule … a playoff team’s schedule”. With Brady being suspended four games, I think it makes that division up for grabs.
