Supreme Court Quashes Governor’s Powers, Restores Nabam Tuki As Arunachal Chief Minister

Tuki government complained regarding central party’s alleged swearing in so as to bring governance in its name but Supreme Court was revising its decision gave the nod in favour of Congress led governance in Arunachal Pradesh. The bench has said that all steps and decisions taken by the legislative assembly after the governor’s December 9 order were unsustainable and liable to be set aside.

Other members of the bench were Justices Dipak Misra, M.B. Lokur, P.C. Ghose and N.V. Ramana.

“Thank you Supreme Court for explaining to the Prime Minister what democracy is”, he said in a post on Twitter.

“The Supreme Court verdict today is a historic”.

Union Law Minister Ravi Shankar Prasad told reporters the SC judgement restoring Nabam Tuki government required “structured examination”.

“Pul was a minister in my government, and as per the Supreme Court’s order, he is still very much part of the Congress family”. Trying to distance himself from the judgment, a setback for BJP which supported CM Kalikho Pul’s People’s Party of Arunachal government, Rijiju said the developments in the state were an internal matter of Congress. “This is Congress’s internal matter”. Following the court’s order, Tuki took charge as Chief Minister at Arunachal Bhawan Office in Delhi. The apex court held that there can be no interference at the behest of the Governor as long as democratic process in the assembly functioned through a majority government.

Reacting to the judgement, Arunachal Chief Minister Khalikho Pul said he would file a review petition against the Supreme Court judgement after going through it in detail and consultation of experts.

In Arunachal Pradesh, 14 congress MLAs were disqualified by speaker on December 15th, 2015.

Earlier today, a five-judge constitution bench pronounced the verdict on a bunch of petitions dealing with discretionary powers of the governor to summon or advance the assembly session.

As of December 15 a year ago, Congress had 47 MLAs in a House of 60 with BJP 11 and Independents two.

He had directed that the resolution for the removal of Speaker Rebia moved by the dissidents including opposition BJP lawmakers taken up as item number one and the party composition of the state assembly would remain unaltered.
