Delhi government stands by new circle rates

The Kejriwal government on Thursday made public its stand that it was well within its rights to notify new circle rates for agricultural land and “there was no need of seeking the approval of lieutenant governor Najeeb Jung”.
The Delhi government’s response came on a plea filed NGO Nyayaa Path, which has sought stay on the advertisements, immediate withdrawal of a recent television advertisement and for “restraining itself (city government) from such type of image building exercise of Arvind Kejriwal”. Meanwhile, the Delhi Chief Minister said that he discussed his desire to open a film city in the national capital with Sinha.
Chidambaram’s letter, the AAP government argued, was based on the opinion of then Attorney General GE Vahanvati, who categorically said that fixing of circle rates exclusively falls within the domain of the elected government and the L-G is bound by the aid and advice of the council of ministers in this matter. Delhi Deputy Chief Minister Manish Sisodia and AAP spokesperson Ashutosh were also present at the meeting.
“The honourable L-G, however, has maintained that the earlier practice of seeking his approval on all matters be continued”. Sinha found it convenient to skip “Mahaparivartan” rally addressed by Prime Minister Narendra Modi in Muzzafarpur last month which was attended by all political figures aligned to the BJP. “This is not possible due to the well laid down constitutional provisions and the above mentioned 1998 judgment of the Delhi High Court”, the government said.

Earlier in the day, hours after a statement by the LG’s office, Delhi government sent a file pertaining to the enhancement of circle rates on agriculture land for Jung’s approval. “A final decision will be taken keeping in mind the Constitution, law and set conventions”, it said.
