With this the court also deemed the May 21, 2015, notification of Centre barring Anti-Corruption Bureau from proceeding against central government employees as neither illegal nor unsustainable.

Frowning upon the Delhi government’s multiple petitions, the Supreme Court on Friday asked the Aam Aadmi Party (AAP) government to explain why its suit for declaring the national capital a state should be heard.
Attorney General Mukul Rohatgi, who was appearing for the Centre, questioned how the AAP government could have filed a suit in the Supreme Court simultaneously as they were pursuing a separate remedy under the writ jurisdiction of the Delhi High Court.
“Thus, Delhi admittedly is a Union territory and shall be governed by the provisions enumerated under Part VIII of the Constitution”, the high court said.
Rai, who is Labour Minister in the Kejriwal government, said “Delhi government is exercising all its powers given under the Indian Constitution”.
“L-G is the administrative head of National Capital Territory” and not the Chief Minister Arvind Kejriwal”, the court said at the end of hearing a number of petitions.
The court did not approve of the AAP government’s decision to appoint its nominees as directors on the boards of private discoms on the ground that there was “huge” corruption in their functioning. It further added that that Delhi government notifications must be issued after consulting the LG. “But we were immediately branded as the B-team of the BJP when we raised our concerns”, a senior government official said.
On Thursday, the HC had ruled that the capital “continues to be a union territory” under the administrative control of the Lieutenant Governor and “does not acquire the status of a state”. AAP’s Delhi unit convener Dilip Pandey said.
Pronouncing the verdict, the High Court said the Lieutenant Governor is not bound to act as per the advice of the Delhi Cabinet.
