Sandusky took the stand on the first day of the appeal hearing. The second day of Sanduskys appeal hearing is getting underway on Monday. Joseph Leiter, a retired state police investigator.
They also argued that there was no consensus on whether Shubin’s client was actually “Victim 2” at the time of trial. But Lindsay said he could not call the man known as Victim 2 to the stand.
A majority of the four-hour hearing focused on the abuse of Victim 2, who previously self-identified as the boy that former Penn State coach Mike McQueary spotted in the shower with Sandusky in 2001. The judge did grant his motion but allowed Sandusky’s attorney to question him about victim 2 and what his role was in representing them. But Peterson said the victim told other officials that he never gave his attorneys details, only telling them that “sex had occurred”.
The prosecution is hinting that because portions of the man’s story remained in doubt, uncertainty about the victim’s identity expressed at trial were not necessarily untruthful.
The hearing is expected to last through the afternoon.
Sandusky argued his defense attorneys did not do an adequate job during his trial.
Sandusky offered no testimony Monday.
Sandusky continues to maintain his innocence, and appeared to bristle when Shubin condemned his abuse of the young men that later became Shubin’s clients in civil cases against the university.
BELLEFONTE, Pa. (AP) Jerry Sandusky’s lawyers are focusing on conflicting statements from a man who settled a child sex abuse claim with Penn State but didn’t testify at Sandusky’s criminal trial.
The man who claims to be Victim 2 contacted Sandusky’s then-lawyer, Joe Amendola, soon after Sandusky was first charged in November 2011 and gave a statement saying he was in the shower that night but had not been abused.
