Kashmir issue can be resolved politically, not judicially: SC
Speaking at an official function in the Bhagwati Nagar area of the city, Mehbooba, who visited Jammu for the first time since violence began in the valley last month, said some elements “who do not want peace in Kashmir” are inciting youths to violence “for their vested interests”.

“Certain quarters are not happy with the PDP-BJP coalition in the state and they have been out to unsettle the alliance”, she said.
The Centre had on August 5 told the apex court that there was a “remarkable improvement in the situation in Kashmir valley which was plunged into violent protests following the killing of Hizbul Mujahideen commander Burhan Wani and two others on July 8”.
Expressing concern over the recent incidents of stone pelting on the trucks belonging to Jammu province engaged in transport of ration and other essential commodities to Kashmir Valley, he said instead thanking some of the miscreants of the Valley are beating, looting and pelting stones on the trucks. “If they (opposition parties) think they can find a solution by this, it is a good thing”, she added.
“The political leadership in New Delhi and within the state must jointly work to initiate the confidence-building measures to respond to the people’s innermost yearning for peace with dignity”, she said.
The bench said this in course of the hearing of a petition filed by Jammu and Kashmir National Panthers Party seeking direction to Jammu and Kashmir Governor to intervene in the prevailing situation and take over the administration of the state by suspending the assembly.
CJI Thakur clearly told him that since the issue has certain dimensions, a judicial order will not suffice and a solution can only be found out at the political level. “Neither the stones nor the guns either in hands of the militants or the in the hands of security forces would enable a peaceful solution of the Kashmir problem”, she asserted.
Those who attending the meeting Sunday included former Orissa High Court judge Ishrat Masroor Quddusi, former Rajya Sabha member Shahid Siddiqui, security analyst Qamar Agha, Milli Gazette editor Zafarul Islam Khan, Supreme Court advocate Ashok Bhan, former J&K interlocutor M M Ansari and former AAP leader Mufti Shameem Kazmi. She said at the same time, the people shall also have to give peace and reconciliation process a chance to take shape as had happened between 2002 and 2003. “We shall have to ponder over how long we are going to allow this self destruction to continue?” she said.

“Some of us were of the opinion that strongly-worded statements, including by many senior ministers, in which Kashmiris were accused of acting at the behest of Pakistan, were only adding fuel to fire and should be avoided. The situation in the state keeps changing by the hour for which there is no judicial remedy”, the court said.
