A former player with the OHL Windsor Spitfires has been found guilty of sexually assaulting a 16-year-old girl in the washroom of a Windsor, Ont., bar in March 2013.
“‘I’m not here to choose which story I prefer, ‘ Re: both Johnson & the alleged victim have VERY diff [erent] versions of what happened”, tweeted Maluske, per Justice Kirk Munroe.
New Jersey’s third-round pick in the 2012 NHL draft played last season for the Albany Ducks of the American Hockey League and the Adirondack Thunder of the ECHL.
Johnson’s lawyers argued their client never had sex with the victim in a downtown bar’s bathroom in 2013, suggesting other consensual contact was made with the girl.
The organization will have no further comment.
Based on evidence provided by witnesses in the bar that night and a sexual assault nurse, Munroe said that Johnson’s testimony was “unbelievable”.
Based on the evidence provided in the 10-day trial the judge determined a blood stain found on the victim’s trousers was from a tear of the hymen and not from her menstrual cycle as Johnson testified.
Johnson testified that the victim pulled him into the stall, but the judge rejected his story.
