Ireland fully behind corporate tax regime ahead of review – minister

Ireland’s cabinet agreed on Friday to join Apple in appealing against the tax demand, Reuters reported.

Some Irish voters are critical of the Government turning down a tax windfall equivalent to what it spent previous year funding the struggling health service.

It took three days to come to this decision, but it isn’t over just yet.

Taxation is a national competence in the 28-country bloc, but the European commission holds the view that the sweetheart tax deals struck by Apple and other with countries such as Ireland, the Netherlands and Luxembourg constitute illegal state aid, an area it regulates.

Apple CEO Tim Cook, however, argued in an open letter that while Apple is a great supporter of global tax reform to promote “simplicity” and “clarity”, new rules shouldn’t be applied retroactively. There are a couple of reasons for Ireland to do this.

These profits were not subject to tax in any country under provisions of Irish law that are no longer in force. They want to know that the tax legislation of member states is what will apply if they invest in those countries.

After Apple said it planned to appeal against the decision, Finance minister Michael Noonan said Ireland planned to do the same.

Commissioner Hogan said Brussels and Dublin understands each other’s positions.

The sovereignty of European nations over the EU has been a hot issue as of late. It has two months to decide whether to appeal.

Apple was found to hold over $181 billion ($238 billion Cdn) in accumulated profits offshore, more than any USA company, in a study distributed a year ago by two left -leaning nonprofit groups, a policy critics say is meant to abstain from paying US charges.

This was another point stressed by Cook. Apple’s “head office” in Ireland has no premises and no employees. But the company will be relieved to learn that the Government of Ireland is in its corner.

“We need to ensure that Ireland’s corporation tax code meets these new standards while remaining competitive as the economy continues to grow”.
