Mallya has sought exemption in a 2000 FERA violation case. A K Ravi Nedungadi, director, UBL also said that Mallya has attended board meetings via video conference and he can continue to be chairman as per the Company Law.
In April 2016, Mallya’s Indian passport was revoked by the Ministry of External Affairs after numerous summons by the Enforcement Directorate failed to get him back to the country.
“The absence of the alleged contemnor on August 29 (date of last hearing) leaves no doubt that he (Mallya) has scant respect for the apex court” and also there is no reply filed to the contempt notice issued by the SC, the consortium said in its reply to the recall application.
The chief metropolitan magistrate court in Mumbai had last week issued a non-bailable arrest warrant against promoter of defunct airline Kingfisher Airlines Ltd (KAL) Vijay Mallya and its chief executive Sanjay Agarwal in a case filed by service tax. He further said that, as of now, the ED had “not attached” any properties and shares of UBL and Mr. Mallya is not disqualified to be the chairman of the company.
The ED had recently expanded the probe to include investigation into the alleged default of loan taken from an SBI-led consortium of banks.
The total attachment made by the agency in this case has now shot up to Rs 8,041 crore as it had attached assets worth Rs 1,411 crore a few months ago.
Bengaluru-Beleaguered liquor baron Vijay Mallya will continue to be the chairman of United Breweries Ltd (UBL) though he is out of India since March and has not presided over board meetings, said an official on Wednesday.

Despite all these seizures, the principal debt of Rs4,930.34 crore still remains unpaid.
