Assistant Chief Troy Gay said Magee admitted shooting the security guard in the foot when he returned. Approximately 45 minutes later, around 3 a.m., authorities say Magee came back with two other men.

According to Cindy Posey, associate director of communications for university operations, the injuries the security guard has are not life-threatening. A search of UT’s directory does not show Magee as a registered student.

In the report, members of the fraternity asked an on-site security guard named Edward Earls to kick Magee out because he was causing issues.

Police said in the affidavit that the security guard will need surgery on his foot to fix the damage caused by the bullet. “We will provide assistance to Austin Police as they investigate this morning’s off-campus shooting”.

UT said in a statement that they’ll offer counseling and support to students who were at the party or affected by the incident.
