Minnesota Supreme Court’s decision keeps Trump on ballot

Trump’s name was added to the state ballot at the last minute, and the Democrats now want a judge to direct the secretary of state to decertify Trump and Pence from appearing on the ballot.

Party filed the legal challenge Thursday petitioning the state’s highest court to remove Trump and running mate Mike Pence from the Minnesota ballot.

“The Minnesota GOP did not elect alternate presidential electors at the state convention earlier this year”, Minnesota DFL Chairman Ken Martin said in a statement.

Hitzemann said, “It was presented to the secretary of state and accepted by the secretary”.

Politico said the move follows a slight dustup in August over the Republican presidential ticket’s absence from Minnesota’s ballot. It could cause the parties to spend some of the rushed final eight weeks of the election fighting in court, distracting from other campaigning. “The Minnesota Supreme Court recognized and upheld that right”. And that’s a concern the court has already indicated it has. The court’s decision was quick: The DFL filed its petition five days before the court blasted it.

In response, Democrats said they filed as quickly as they could and no one would be hurt by the delay.

Martin and the DFL’s argument had to do with choosing and submitting names. Besides, it says: “The election is two months away”.

“The state party leadership ignored state law”, the DFL claimed.

Courts tend to weigh in favor of giving voters meaningful choices in elections, despite odd circumstances, they said. Martin also argued that the remedy pursued by the state GOP was not lawful under their bylaws.

“Donald Trump got on our ballot fair and square, and it is outrageous that the Democrat Party would actually try to rig the election this way”. “But the petition that seeks a change in a candidacy designation that the Secretary of State has already certified can not lose sight of the fact that every day of delay increases the potential prejudicial impact on election processes and the electorate’s right to vote”.
