Lawmakers Override Nixon’s Veto To Pass Constitutional Carry In Missouri
Both votes by the Republican-controlled state House and Senate reached the two-thirds majority required to enact legislation over the governor’s veto. “Why not have more certainty in the election process?” The NRA says 30 states have laws or court precedents stating people have no duty to retreat from a threat anywhere they are lawfully present.
“Putting additional and unwanted barriers between citizens and their ability to vote is wrong and detrimental to our system of government as a whole”, Nixon said in his letter explaining the veto. The House must override the veto before it becomes law.
Sen. Mike Parson is the sponsor of the new law.
In the Senate, Chappelle-Nadal called the implementation bill “a definite step backwards.What we should be promoting is inclusion and activism for all people, so that people do not feel as though their government is turning their back on them, or their parties”. That “stand your ground” provision goes into effect on January 1.
That led Rehak into a battle to change Missouri law, exempting sales tax payments for personal instructors in dance, gymnastics, martial arts and things like that. Flanigan supported the bill when it first passed.
The legislation will allow most people to carry concealed guns without needing a permit.
“This bill will not do the insane things that are being said”, he said.
“You don’t want to be less tough on crime”, Flanigan said.
“The problems are too great for me to support the bill at this time”, Flanigan said.
Nixon’s budget office estimates the tax break could cost the state almost $52 million.
This push has come with a huge price: a 2014 study found that following the repeal of state laws requiring comprehensive background checks and purchase permits, Missouri’s gun homicide rate increased by more than 15 percent - as the national rate dropped 11 percent.
The rally had about 150 participants, who then spanned out to their lawmaker’s offices to ask them to uphold Nixon’s veto.
In order to override a veto, the House must attain 109 votes, while the Senate needs 23 votes. However, in his veto letter, Nixon said he was concerned that anyone can hide a firearm under the new legislation, including someone who has been charged with but not pled guilty to a felony; has pled guilty to a felony with a suspended imposition of sentence; has been convicted of a misdemeanor assault; or has beee convicted of two or more DUIs or drug possession offenses in the past five years. Each chamber contains a supermajority of Republicans, but no veto is guaranteed.
