Ex-Virginia gov. renews plea to remain free during appeal
McDonnell appealed to the Supreme Court last week, after a federal appeals court announced that his corruption case wouldn’t be revisited and his convictions were upheld. Her lawyers argued Wednesday that while her husband’s appeal resolved numerous issues in her case, the federal bribery statute under which they both were convicted was unconstitutionally vague – at least when it came to the former first lady. His next step is an attempt before the U.S. Supreme Court. Those gifts included luxury clothes for the former first lady. The former Republican governor, once considered a possible running mate to Mitt Romney in 2012, has been sentenced to two years in prison.

McDonnell asked to remain free during his ongoing appeals process and, in a motion filed Monday, claimed he poses no risk of flight or public endangerment. They say McDonnell’s case clearly raises important legal questions that merit review by the high court.
Her attorneys note that Maureen McDonnell is not an attorney and has never been elected to office.

Prosecutors are set to reply by September 9. Arguments in her own, separate appeal are schedule for October.
