Samsung taking Apple case to US Supreme Court

It’s a long shot from the company, but the appeal will probably find backers in Silicon Valley, with the San Jose Mercury News reporting that companies including Google and Facebook are likely to urge the Supreme Court to examine the case.

Yesterday we heard that the USPTO had invalidated one of Apple’s patents that was used in the lawsuit against Samsung, this could play a part in the appeal with the Supreme Court.

If it feels like the legal battle between Apple and Samsung has been going on for years, well, that’s because it has.

But even so, the fight could effectively already be over as the chances of the Supreme Court agreeing to hear the case are not in Samsung’s favor.

The invention in question is Apple’s US Patent D618,677 which associates to design elements of the front portion of the Iphone, including its curvy corners.

Samsung appealed a San Jose jury’s August 2012 verdict that it violated Apple’s patent or trademark rights in 23 products, such as the Galaxy S2 smartphone, as well as about $930 million in damages awarded to the iPhone maker. Another federal jury last year found Samsung copied iPhone technology in more recent products, but awarded $120 million in damages, a fraction of what Apple sought. The noise about the invalidity of the case was made to get headlines needed to bolster Samsung’s case.
