Fenner is accused of fatally shooting 38-year-old Tim Brackeen, a K-9 officer with the Shelby Police Department.

Fenner is the sister of the suspected shooter and it is believed “that the brother stayed at her house” while on the run, a source said.

Brackeen was attempting to serve that warrant in the area of Parkview Street of Shelby when Fenner allegedly shot him. Brakeen died of his injuries Monday and Irving was suffering from a bullet wound to the abdomen when he was apprehended, according to investigators. A struggle broke out between Fenner and Officer Timothy Brackeen, and the two exchanged gunfire.

Authorities arrested the man accused of killing a Shelby, North Carolina police officer early Wednesday morning in Rhode Island. Cops there raided a home Tuesday evening – but Fenner was nowhere to be found.

‘It took a while for him to come out, and when he did he was in pretty bad shape, ‘ Philbin said.

State police say they tracked Fenner to an apartment in Coventry, where he surrendered peacefully early Wednesday.

Fenner was charged with attempted murder in connection with Brackeen’s shooting.
