According to the AP, U.S. District Judge Michael W. Fitzgerald ruled Tuesday that the identity of Rose’s accuser will not remain anonymous at a trial set to begin October 4 – an apparent reversal from the judge’s remarks four months ago, when Rose’s lawyers argued for the unveiling of Doe’s identity due, in part, to a “sexually suggestive” Instagram feed that “belies her apparent desire for anonymity”.
Anand, however, explained to the Post that judge Michael W. Fitzgerald ruled to take away the woman’s anonymity in order to protect the jury from being unfairly biased.
Also during last week’s teleconference, Doe’s lawyers revealed that in a deposition Rose was asked to define “consent”, which he was unable to do.
“I want to share my story so women can know that they are able to come forward and remain anonymous and not to have to have the burden or the worry that their loved ones will find out”, she told the Associated Press in an interview before the judge’s decision. She has claimed she was intoxicated and did not consent to sex with the three men. He noted that if publications chose not to use the woman’s name, then that was a journalistic decision.
An attorney for the woman told The Huffington Post that he expects the media attention to be hard for his client. Rose has denied all allegations in the complaint and argued in a court filing last September that sex with the woman – who was in a relationship with him at the time – was consensual.
“They’re elderly and I’m a part-time caregiver for my mother, so it’s very important for me to do everything I can to make sure that my family’s needs are met and they’re still in good standing and have no stress or pressure placed on them”, she said. She says Rose, his friend, and his manager followed in another auto, came in through an unlocked door, and took turns raping her in the apartment, and she woke up with used condoms around her and her legs covered in lube.

Rose and the woman dated non-exclusively for two years before the alleged rape. “Plaintiff’s use of twitter and other forms of social media further belies her apparent desire for anonymity”. She claims she was so drunk a taxi driver had to help her get to her apartment, where she vomited, passed out and woke up the next day still clothed. “I know she’s going to be hesitant”, he said. That could be enough to force her to settle and allow Rose to go on with his life, which is exactly what his lawyers are seeking, understandably.
