Barrister James Viney entered not-guilty pleas on the 12-year-old boy’s behalf to the charges of three counts of aggravated indecent assault in company, two counts of sexual intercourse with a child under the age of 10 and one count of indecent assault.

The boy and another 12-year-old boy were accused of sexually and indecently assaulting a six-year old girl at their school during school hours.

At a Children’s Court on Thursday, the boy’s defence barrister James Viney formally entered a not guilty pleas to the charges on the boy’s behalf.

The lawyer also asked the court if the boy’s bail conditions could change so he could go interstate on a family trip and be excused from his November 24 court date.

The other accused is on bail and is expected to appear in court on October 20 to face similar charges.

There was some debate in court regarding media coverage of the case, the Herald reported.

The remaining offences allegedly occurred on 16 August between 8am and 4pm, involving indecent assault and sexual intercourse with the six-year-old girl. She was apparently attacked by the two boys in the first encounter, and only by one on August 16.

The case has been referred to the Department of Public Prosecutions and the boy’s next hearing will be on 24 November.
