Aaron Hernandez lawyer allowed to question juror tipster, judge rules

In her ruling, Garsh wrote that the woman will be questioned by attorneys in the case while a judge is on the bench to deal with any objections raised by prosecutors and defense lawyers.

She added that the questioning of the female informant will be in court in the presence of Hernandez but it will not be open to the public.

The woman has not been identified in court documents. Hernandez’s lawyer, James Sultan, has said that “Katy” has been reluctant to cooperate, and that she has refused to provide a written affidavit. McCauley attacked the woman’s credibility and said there were ulterior motives behind her “implausible claims”.

Hernandez is serving a life sentence with no hope of parole in maximum security at Souza Baranowski state prison in Shirley. She has alleged that one of the jurors who rendered a guilty verdict in the murder of Odin Lloyd was a former co-worker of hers and “was present for a discussion about the charges in Boston”.

Hernandez had been a rising NFL star with a $41 million contract when he was arrested on June 26, 2013, nine days after a teenage jogger discovered Lloyd’s bullet-riddled body in an industrial part near the player’s North Attleboro, Massachusetts, home.

Hernandez is also charged with gunning down two men in 2012 after an encounter at a Boston nightclub and is scheduled to go on trial later this year.

Sultan acknowledged the woman had extensive contact with Hernandez but said there was reason to believe she had relevant information.

“If a real possibility exists that a miscarriage of justice had occurred here, it is the Court’s duty to get to the bottom of it”, Hernandez’s attorney wrote in a filing that fought back against prosecutors’ attempts to block the review.
