Former Indianapolis Colts linebacker Josh McNary is set to stand trial for rape.

According to the Indianapolis Star, the woman told detectives she scratched her attacker, and when they interviewed McNary, they noticed he had scratches and abrasions on his neck, abdomen, shoulder and back.

Josh McNary was charged with rape, criminal confinement and battery resulting in bodily injury in January after an alleged incident in December. He denies the allegations.

McNary stayed quiet as he was surrounded by news cameras after he emerged from the courtroom Monday morning. That’s when she says she resisted several advances from the man who she says then raped her.

“We have no comment at this time”. “We just have to let the jury do it’s thing. That’s been my position all along”, Schrager said.

The woman took McNary’s cell phone when she left the apartment, which is how police connected him to the case.

However, defense attorney Jessie Cook said the accuser is “a confused young woman” who “drinks too much” and mixes medication with her drinks. They also argue her story about the night in question has repeatedly changed.

The trial is expected to last most of the week.

McNary was placed on the NFL’s Exempt/Commissioner Permission List, meaning he isn’t officially off the team, but is unable to practice or attend games.
