Actress Kelly Rutherford in court for custody battle

Rutherford’s lawyer, Wendy Murphy, sent a lengthy statement to USA TODAY on her behalf via email, claiming that the New York judge had no authority to force her children to leave the country.

Celebrity Kelly Rutherford was compelled to deliver her two kids back again to Portugal on Wednesday for declining to follow a custody order given with a Monaco standard following a New York judge chastised her. Giersch’s mother was in court to greet the children Tuesday.

The 46-year-old “Gossip Girl” star was ordered by a Manhattan judge to return her children, Hermes, 8, and Helena, 6, to Monaco, where their father lives, reported Us Weekly. “Given Kelly’s initial failure to send the children back, showing up without them was probably the nail in her coffin”. “My children ask me all the time if I am still fighting for them, and I always tell them the day will never come when I say ‘no'”.

Rutherford’s latest statement also detailed how Gesmer broke the law herself.

Rutherford’s refusal landed the case in court, where the judge ruled against Rutherford. It doesn’t matter if you’re a judge in New York, California or Monaco, where this case ends up.

Rutherford believes Gesmer is in the wrong. “I did my best to comfort the children, but there are no words to help children understand why a judge would be so cruel”. The former couple originally agreed to share custody of their children, but after Giersch was refused re-entry into the United States, due to his U.S. visa having been revoked, a judge ordered the children should live with him in France. For now, she has to face court and the accusations her ex husband is accusing her off. “The children’s father didn’t care enough about his children to be here himself”.

He claimed she was refusing to turn over the children’s passports. In stead, the kids left for the aiport with their paternal grandmother shortly after the decision was made on Tuesday. They hugged and said goodbye to their mother, and she said she will see them soon.

His attorney Ira Garr added: “It was done very civilly”.

In the final portion of her statement, Rutherford vowed that the battle for her kids will proceed.

“What the judge did yesterday was shocking, illegal, and abusive to my children”.

‘In addition, his stance of promoting Kelly’s time with the children has not changed’. “I have decided that I can not lawfully send my children away from the United States to live in a foreign country”, she wrote.

The next court hearing is scheduled to take place September 3 in Monaco.
