“Affluenza” teen, mother detained in Mexico

Speaking with CTV News, Toronto criminal defence lawyer Ari Goldkind says Couch is in a lot of trouble, especially after receiving what he says many people justifiably considered a slap on the wrist.

His case made national headlines twice: When a defense witness testified that he suffered from “affluenza”, too influenced by privilege and his parents’ permissiveness to know right from wrong; and when a judge appeared to accept the argument and sentenced him to 10 years’ probation, rather than prison. The term “affluenza teen” came into play, although it is not a condition recognized by the American Psychiatric Association.

The district attorney’s office has long warned that Couch could face jail time if he violated the terms of his probation. It was not clear whether they had any accomplices.

It’s not yet known which charge Tonya Couch will face. Mexican detectives started searching on December 24 and caught up with them at about 6 p.m. Monday.

The Couch case appeared to be the first time it was explicitly offered as a defense. Prosecutors say a woman who worked there helped authorities capture the pair.

The two were captured at the crossing of two streets near the popular Malecon, or seafront promenade, in Puerto Vallarta.

A photo of Ethan Couch released by Mexican officials showed him with his blond hair, beard and mustache dyed a dark color.

Couch is wanted by authorities in Tarrant County, Texas, for violating his probation.

“We have now had an arrest warrant issued for Tonya Couch for hindering an apprehension”, the sheriff said.

Due to his age, he wasn’t certified as an adult for trial and a judge sentenced him in juvenile court to 10 years’ probation and a stint in a rehab centre.

Couch would then face up to 120 days in an adult jail, followed by 10-year probation.

If a judge rejects the transfer, Couch may instead complete his sentence in a juvenile facility until he turns 19 in April.

Ethan Couch’s attorney, Reagan Wynn, said in a statement he had not had the chance to speak with his client and did not expect to be able to until Couch was back in the United States. “They would have had to enter, for example, as tourists, but they entered without registering”.

The official, who is not authorized to be quoted by name, told Associated Press reporter E. Eduardo Castillo that there are no seats available on commercial flights to allow a Tuesday return.

In June 2013, a drunken Couch was speeding on a road south of Fort Worth when he crashed into an SUV at the side of the road, killing four people and injuring several others, including passengers in his pick-up truck.

Couch pleaded guilty to four counts of intoxication manslaughter and two counts of intoxication assault causing serious bodily injury.
