‘Affluenza’ Teen’s Mom Charged with Felony, Lawyers Say She Did Nothing Wrong

It is now unclear why she was transported to California as opposed to Texas.

(Mexico’s Jalisco state prosecutor’s office via AP)FORT WORTH, Texas (AP) – The Texas teenager who used an “affluenza” defense in a deadly drunken-driving wreck grew up in a wealthy yet unstable household where his parents underwent an acrimonious divorce, which included accusations that his mother was addicted to pain pills and his father was abusive.

Treaties between the USA and Mexico say that Mexican authorities have to respect Couch’s warrant in the US, so unless he files for asylum, he will not be able to stay in Mexico indefinitely, said Aldo Salazar, a Texas attorney also licensed to practice in Mexico.

An official with Mexico’s Migration Institute told an Associated Press reporter on Wednesday that 18-year-old Ethan Couch won a three-day court injunction.

It was not immediately clear why Tonya Couch was not included in the judge’s injunction.

After the two were arrested on Monday, hotel workers found a large-caliber revolver that they said the Couches brought with them, according to ABC News.

“Bail is set at $1 million with the condition that it be made in open court here in Fort Worth”, Wilson said.

Even if a Mexican immigration court does decide to send Couch back to the United States, he might not face much time behind bars.

Tonya Couch had her nursing license revoked in 2012 for failing to disclose a reckless driving charge in 2003, according to the Texas Board of Nursing.

Couch disappeared earlier this month after he missed a mandatory meeting with his probation officer.

Anderson said when Ethan Couch arrives back in the United States, he would appear at a detention hearing in the juvenile justice system.

Her attorneys released a statement saying she had done nothing illegal and wanted to get back to Texas as soon as possible. Both were taken into custody Monday, Dec. 28, after authorities said a phone call for pizza led to their capture in the resort city of Puerto Vallarta.

He apparently vanished after the emergence of a video showing Couch at a party taking part in a drinking game, which violated the terms of his probation.

Couch was on juvenile probation after killing four people in a drunken-driving wreck.

The report says mother and son were, “confusing about their names and mentioned they had no identification and no immigration documents”.

The stiffest punishment Ethan Couch can receive for fleeing the country while on probation is several months in jail, Wilson said Tuesday. Jordan said the timing of Couch’s return to Texas is contingent on when Los Angeles County schedules an extradition hearing. Local police said the pair stayed at a condominium complex for a few days before moving to an apartment.

The analysis isn’t acknowledged by the American Psychiatric Association and was extensively ridiculed.

Couch’s attorneys, Scott Brown and Reagan Wynn, said they won’t comment until they speak with him, which likely won’t happen before Couch reaches the U.S. He pleaded guilty to four counts of intoxication manslaughter and two counts of intoxication assault causing serious bodily injury and was sentenced to 10 years’ probation. The decision was made because the Mexico City facility for detaining migrants is bigger and better equipped to hold someone for days or weeks. “Yes, but I think it is delaying the inevitable”, said Dallas attorney Peter Schulte, who specializes in juvenile law.
