Van Dyke was initially charged November 24 with a single count of first-degree murder in McDonald’s shooting. Van Dyke was indicted earler in the week on six counts of first-degree murder and one count of official misconduct for fatally shooting McDonald.
The Justice Department announced it would conduct a “pattern or practice” investigation of Chicago Police in the wake of the release of the video showing Police Officer Jason Van Dyke shooting McDonald, 17, in October 2014.
The seven-count indictment against Van Dyke came as no surprise to his attorney, Daniel Herbert, who said he’s still weighing whether to request a change of venue based on the massive amount of pretrial publicity, much of which he believes has come from City Hall. Van Dyke shot the teen 16 times in a 2014 shooting captured on a squad vehicle video.
Herbert told reporters he wants the trial moved to a county “outside the reach” of Mayor Emanuel’s comments.
At a news conference Thursday, the retired officers joined the ranks of those who have been voicing distrust of leaders including Mayor Rahm Emanuel since last month’s release of the video of the McDonald shooting.
Department of Justice officials have finished two days of meetings in Chicago as they begin a civil rights investigation into the city police department.
